Terms of Service

By accessing or using FlowApp Studio ("the Platform"), you confirm that you are at least 18 years old, have the legal capacity to enter into binding agreements, and accept these Terms of Service in full. If you are using the Platform on behalf of an organization, you represent that you are authorized to bind that organization to these terms. These Terms govern your use of our web application, APIs, SDKs, developer tools, and all related services. We may update these Terms from time to time. Significant changes will be communicated via email or an in-app notice at least 14 days before taking effect. Continued use of the Platform after changes constitutes acceptance.

FlowApp Studio is a visual flow-building platform that enables you to design, deploy, and manage interactive conversational experiences. Our services include: • A drag-and-drop flow designer for building USSD menus, chatbot conversations, survey systems, and voting applications • Multi-channel deployment via USSD, SMS, messaging apps, and web • Real-time analytics, session tracking, and reporting dashboards • REST API and SDKs for programmatic flow management • Webhook integrations for real-time event delivery • AI-assisted flow design and optimization tools We reserve the right to modify, suspend, or discontinue any feature with reasonable notice. Features in beta or preview are provided as-is and may change without notice.

To access the Platform you must register an account with accurate, current information. You are solely responsible for: • Maintaining the confidentiality of your login credentials and API keys • All activities conducted under your account, including actions by team members you invite • Promptly notifying us at security@flowappstudio.com of any unauthorized access or suspected breach • Ensuring each team member added to your account understands and complies with these Terms You may not share your account credentials or API keys publicly. We strongly recommend enabling two-factor authentication. We are not liable for losses arising from compromised credentials resulting from your failure to maintain account security.

You agree to use FlowApp Studio only for lawful purposes. The following uses are strictly prohibited: • Designing or deploying flows that facilitate fraud, scams, or deceptive practices • Sending unsolicited bulk messages (spam) through any connected channel • Violating applicable telecommunications regulations in your jurisdiction • Collecting sensitive personal data through flows without explicit user consent and appropriate security measures • Attempting to reverse-engineer, decompile, or extract the source code of the Platform • Using the Platform to conduct denial-of-service attacks or other disruptive activities • Reselling access to the Platform without our prior written consent We reserve the right to suspend accounts involved in prohibited activities without prior notice.

FlowApp Studio and all its components — including the interface, underlying software, documentation, branding, and proprietary algorithms — are owned by us and protected by applicable intellectual property law. You retain full ownership of the flows, content, and data you create on the Platform. By uploading or publishing content, you grant us a limited, non-exclusive license to host, process, and transmit that content solely as necessary to provide the service. You may not: • Copy, adapt, or create derivative works based on the Platform • Remove or obscure any proprietary notices • Use our name, logo, or trademarks without prior written permission We welcome feedback and suggestions. By submitting them, you grant us an irrevocable right to use them without any obligation to compensate you.

Paid plans are billed on a monthly or annual basis in advance. By subscribing, you authorize us to charge your payment method on each renewal date. Pricing: • Platform access fees are as stated on our pricing page at the time of subscription • Session-based usage fees are calculated monthly and billed at the end of each billing cycle • We will provide 30 days' notice of any price changes before the next billing period Refunds: • Monthly plans: no refunds for the current billing period upon cancellation • Annual plans: pro-rated refunds are available within 30 days of the initial purchase • Disputed charges must be raised within 60 days Failed payments will result in a 7-day grace period before service suspension. Account data is retained for 30 days following suspension before permanent deletion.

Your use of FlowApp Studio involves the processing of data belonging to you and your end-users. As between you and us: • You are the data controller for data collected through your flows • We act as a data processor on your behalf • We process your data only as instructed by you and as described in our Privacy Policy You are responsible for ensuring you have a lawful basis to collect and process end-user data through your flows, and for providing your end-users with appropriate privacy disclosures. For customers subject to GDPR or other data protection regulations, a Data Processing Agreement (DPA) is available upon request at privacy@flowappstudio.com.

The Platform is provided "as is" and "as available." We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by applicable law, we shall not be liable for: • Indirect, incidental, special, punitive, or consequential damages • Loss of revenue, profits, data, goodwill, or business opportunity • Failures or interruptions caused by third-party telecom providers, payment gateways, or infrastructure • Unauthorized access to your account or data due to your failure to maintain security Our aggregate liability to you for any claim shall not exceed the total fees you paid us in the 3 months immediately preceding the event giving rise to the claim.

Termination: We may suspend or terminate your account immediately, without prior notice, for breach of these Terms, fraudulent or illegal activity, or non-payment of fees. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. We will retain your data for 30 days before permanent deletion. Outstanding fees remain due. Governing Law: These Terms are governed by applicable law. Disputes shall first be attempted to be resolved through good-faith negotiation. If negotiation fails within 30 days, disputes shall be submitted to binding arbitration. You agree that any claim must be brought within one year of the triggering event.
